Cuttings: Faster Start, Stricter Legal Framework
Cuttings are rooted offshoots from a mother plant. The practical advantage is obvious: genetics are identical to the mother, sex is determined, and the germination phase is skipped.
The sourcing method, however, is more narrowly defined than for seeds. Section 20 of the Cannabis Consumption Act specifically regulates cutting transfers only between cultivation associations and their members, limited to five per month, with ID verification and no mail shipping. Commercial mail-order trade in cuttings to private individuals is not covered by this regulation and remains legally contentious.
Lucky Hemp points out that seeds and cuttings have not yet developed the active compound THC. This argument focuses on current cannabinoid content. The law does not tie plant regulations to active ingredient levels, so we don’t adopt this classification. CBD Flowers: The Most Controversial Product Category
The third product line comprises CBD flowers, often called aroma flowers in retail. These are blooms from certified industrial hemp with high cannabidiol content and THC levels below legal thresholds. This product category warrants careful attention to legal status, as considerable misinformation circulates. Two points deserve correction.
- The limit is 0.3 percent, not 0.2. Since 2023, certified EU industrial hemp is subject to a maximum THC content of 0.3 percent. Older references to 0.2 percent are outdated.
- CBD is not unregulated. The occasional claim that cannabidiol operates outside legal frameworks is incorrect. For oral consumption, the European Novel Food Regulation applies, alongside food and consumer goods legislation and the Cannabis Consumption Act.
The decisive factor is the so-called abuse clause in Section 2, Paragraph 3 of the Cannabis Consumption Act. It permits handling industrial hemp only when misuse for intoxication purposes is excluded. The law doesn’t define when that’s the case, and this ambiguity has created a gray zone that has occupied retailers for years and repeatedly led to investigations. Clarification from higher courts is pending, and several district courts have recently ruled against abstract intoxication calculations.

What Else Applies to Home Cultivation
Regardless of sourcing method, fixed limits apply to private growing.
