While Germany continues to debate rolling back its cannabis law, other EU countries are charting significantly more progressive paths. Czechia will legalize home cannabis cultivation starting January 1, 2026. Additionally, psilocybin will be permitted for medical purposes.

Small amounts of cannabis and other drugs for personal use have been decriminalized since 2010. Medical cannabis use has also been legal since 2013. For several years, there has been discussion about officially legalizing home cultivation. The corresponding bill was signed by President Petr Pavel and will take effect next year.
Three Plants and 100 Grams
Persons over 21 years of age may grow three plants at home and possess 100 grams of cannabis starting January 1, 2026. Up to five plants or 200 grams will only be treated as an administrative offense. On the go, 25 grams may be carried. Here too, amounts up to 50 grams constitute only an administrative offense. In its interpretation, the new law is not unlike Germany’s CanG, though it naturally has similar shortcomings: reconciling 100 grams with three plants is hardly practical. In the past, questions have been raised about the rationale of setting a legal limit based on the number of plants.
Former Pirate Party leader Ivan Bartoš compared this limit to three chickens that are only allowed to lay one egg. At that time, a legal ceiling of 50 grams was under discussion, while the Pirate Party demanded a far more realistic amount of 900 grams. The current legislative reform makes no mention of efforts to establish specialized shops or cultivation associations. A regulated market with retail outlets was also proposed multiple times by the Pirate Party in the past, but is not part of the current reform.
Commercial sales remain prohibited. The primary goal is to relieve the burden on the justice system, whose resources should not be tied up with minor offenses. The current legal text also makes no mention of changes to traffic law. Czechia has, however, already established a THC limit of 2 ng/ml in whole blood and is thus somewhat more liberal than Germany.
Part of a Judicial Reform
The legalization of cannabis is part of a comprehensive judicial reform. As former Justice Minister Pavel Blažek confirmed in an interview, the goal of this reform is to clearly distinguish minor offenses from serious crimes. Cannabis for personal use is associated with no socially harmful behavior and should therefore be exempt from prosecution. The reform aims to provide law enforcement with significantly more resources for serious crimes.
Furthermore, the number of incarcerated individuals and spending on minor offenses are to be reduced. This legislative change was substantially driven by Zdenka Němečková Crkvenjaš, a member of the Civic Democratic Party. She emphasized that this judicial reform marks the end of the senseless persecution of people who grow cannabis for personal use. With this reform, Czechia takes an important step in advancing the decriminalization of cannabis in Europe.
Psilocybin for Medical Use
Beyond cannabis, psilocybin will be legalized for medical use. Psilocybin is the primary active compound in magic mushrooms, whose high efficacy for various mental health conditions has been demonstrated through research. Psilocybin will be used primarily for treatment-resistant depression. Administration occurs in a specialized clinic under the supervision of a qualified physician.
