Now there’s a new case from Grafenwöhr in the Upper Palatinate. The association Buds Collective e. V. was set to begin distributing cannabis to its members just days ago but was stopped at the last moment.
Failed Through Legal Hair-Splitting
The Cannabis Social Club Buds Collective e. V. in Grafenwöhr attempted days ago to become Bavaria’s first cultivation club to legally distribute cannabis to its members. However, this plan was blocked by the Bavarian State Office for Health and Food Safety (LGL). The reason: Buds Collective e. V. was using an unlawful distribution location—an administrative violation that could result in fines of up to €30,000. Although all legal requirements appeared to be met beforehand, according to the LGL, distribution at the Grafenwöhr premises was impermissible.
Club board member Christian Pschierer rightfully speaks of administrative abuse and announced plans to make another attempt the following Saturday, November 29th, to distribute cannabis to members while complying with all legal requirements. Earlier in the summer, another Bavarian cultivation club failed due to allegedly unsuitable premises. Franken Cannabis was forced to surrender after a legal defeat shortly after distributing its first shipment to members. In the legislator’s view, the agricultural storage facility designated for this purpose lacked the necessary building permits.
The Region’s First Cultivation Club
Buds Collective e. V. was the first approved cultivation club in the Upper Palatinate. However, the path there was anything but easy. Since spring 2024, the club fought to obtain approval. Finally, in June 2025, all legal requirements appeared—at least seemingly—to be met. The actual cultivation took place in neighboring Saxony, as the legal hurdles were lower there.
Transporting more than 25 grams of cannabis between two locations is not straightforward and requires official approval. Nevertheless, just days ago, there was optimism about being able to distribute the first harvest to club members and make history—but the plan fell apart at the last second.
Bavaria’s Absurd Double Standards
In the land of beer and Oktoberfest, cannabis remains a public enemy. Prime Minister Söder announced at the beginning of partial decriminalization that the law would be implemented as restrictively as possible. While Bavaria now has several approved cultivation clubs, there is still no legal distribution to members.
Every previous attempt has failed because it was sabotaged by administrative abuse at the last moment. Bavaria continues to do everything possible to maximally undermine legal cannabis supply. At the same time, they complain that the black market hasn’t been sufficiently reduced through legalization.
